No developer can be unaware of the mandatory 10% biodiversity net gain (BNG) requirement on all developments the Environment Act 2021 introduced with Royal Assent in November 2021. With Schedule 14 of the Act requiring applicants to submit a biodiversity gain plan at the planning application stage, this webinar will present a practical guide to the legal structures for fulfilling BNG requirements on proposed and existing developments.
On 11 October 2022, our Real Estate team explored planning considerations such as the mitigation hierarchy, conservation covenants and the varied approach of planning authorities, BNG structuring deals, and the effect of BNG requirements on development agreements – implementing existing option and promotion agreements, futureproofing new strategic agreements and phased developments and proposals for front loading.
This webinar was aimed at property developers but will also be of interest to other property professionals involved with satisfying Biodiversity Net Gain (BNG) requirements on commercial developments, residential developments and infrastructure projects.
